I don't see how that doesn't come up at the trial.

It's like his lawyers are saying "well, he didn't hijack a plane and fly it into the Capitol building, so therefore he's innocent. He didn't grab a bullhorn and start screaming 'kill Nancy Pelosi! Hang Mike Pence! So he's innocent, you know?'"
